The Issue
We have numerous clients who are both contractors and sub-contractors in their chosen industry – Bricklaying, scaffolding, etc, and the client in this example is a specialist M&E contractor working for their own clients with large diverse portfolios.
The client has a core of fully employed staff, in managerial site supervisory and site liaison roles. Their site workforce consists of employees and fully skilled sub-contractors working in parallel.
The Risk
In the absence of separate processes, policies and working practices it would have been impossible for the client to defend against the argument that, as there was no difference in the working practices on site, all tradespeople are in fact employees.
The Solution
The self-employed element of the workforce is now outsourced to EEBS. We have completed a full restructure of the working practices and support procedures on site, implemented new contracts and operational systems, works orders and recording systems that supports the new way of working and fully protects the distinction between the employed and self-employed workers.
